Juniper Dance & Fitness School Online Studio website is designed to provide video instruction of Bellydance classes, Pilates classes, fitness classes and to bring together a global community of people interested in Bellydance and related training.

This website is owned by Alexis Fullard (trading as Alexis Southall, herein after referred to as ‘Alexis Southall’). These Terms and Conditions apply to all products, services and websites offered by Alexis Southall and Juniper Dance & Fitness School. 1)Acceptance of Terms

The Terms and Conditions of User Agreement sets forth legally binding terms for your use of this website. If you do not agree to these Terms and Conditions you should leave our website and discontinue use of the service immediately. You agree to be bound by any modification made to this agreement when you use this website after any such modification is posted. It is therefore important that you review this agreement regularly.

2) General Registration Requirements

If you wish to become a member you must read this agreement and indicate your acceptance during the registration process. You agree to provide true and accurate information about yourself as prompted by the registration form, and to update those details as necessary. If we believe that any information you have provided is false, not current or incomplete, we reserve the right to suspend or terminate your account.

Content on the website is provided to you AS IS and is for your information and personal use only. It is not permitted to download, copy, reproduce, distribute, transmit, broadcast, display, sell, licence or otherwise exploit the material for any other purposes whatsoever without written consent of Alexis Southall and Juniper Dance & Fitness School. Accessing website videos for any purpose other than streaming is expressly prohibited.

3) Health Disclaimer

Bellydance, Pilates and any other related fitness training as offered by the website in all of its forms, are strenuous physical activities. Accordingly, you are urged and advices to seek advice from your doctor before beginning any dance or exercise routine and/or programme and use any suggested equipment shown or described in the video clips on the website. All suggestions relating to the use of moves, equipment, poses and instruction are not required to be performed by you and are carried out at your own election and risk while viewing Juniper Dance & Fitness School Online Studio videos. Nothing contained on this website should be construed as medical advice or diagnosis.

By using our website you agree and understand that exercise of any kind is a physically strenuous activity involving physical and mental exercise, and that such a practice carries the risk of injury whether physical or mental. You understand that it is your responsibility to judge your physical and mental capabilities while practicing bellydance and/or any fitness training. It is your responsibility to ensure that by participating in any of the online classes, you will not exceed your limits, you will select classes of an appropriate level of ability. You expressly waive and release any claim you may have at any time for injury of any kind against Juniper Dance & Fitness School and Alexis Southall, or any person or entity involved with Juniper Dance & Fitness School, including without limitation its directors, instructors, independent contractors, employees, agents, contractors, affiliates and representatives.

4) Minors

Juniper Dance & Fitness School content is not directed to persons under eighteen years of age, and by providing information about yourself to Juniper Dance & Fitness School you are representing that you are eighteen years of age or older.

5) Account, Password & Security

You are responsible for maintaining the confidentiality of your password and account information, and are fully responsible for all activity that occurs under your password or account. You agree to inform Juniper Dance & Fitness School of any unauthorised use of your password or account or any other breach of security, and ensure that you log out of your account at the end of each session. Juniper Dance & Fitness School and Alexis Southall will not be responsible for any loss or damage arising from your failure to comply with this agreement.

6) Proprietary Rights

All material on the website are protected by copyright, trademarks, and/or other intellectual property rights owned or controlled by Juniper Dance & Fitness School. No content may be copied, reproduced, republished, sold, downloaded, posted, transmitted or distributed in any way by any person or entity without prior express written permission from Juniper Dance & Fitness School. You may not add to, delete or otherwise modify the content.

7) International Use

Due to the global nature of the internet, you agree to comply with all local rules regarding online conduct and acceptable content. Specifically you agree to comply with all applicable laws regarding the transmission of technical data exported from the UK or the country in which you reside.

8) Term and Termination

This agreement shall remain in force and effect for as long as Juniper Dance & Fitness School is in operation. You may terminate your membership at any time, for any reason by cancelling your Paypal subscription. We reserve the right to suspend or terminate your account if we believe you have breached the terms of this agreement.

9) Membership

1. No Sharing – members of the website may not share or sell their password to any other person or entity. Excessive viewings or logins by any Member will be construed as fraudulent use of the website and will result in immediate cancellation of membership without refund.
2. Fraudulent use – Juniper Dance & Fitness School reserves the right to cancel any membership that it believes to have been compromised or is being used fraudulently at our own discretion.
3. Billing – subscriptions are billed on an ongoing, recurring basis at a time as agreed in your plan subscription. Subscription memberships are renewed until cancelled. Members can cancel their subscription at any time. Subscription membership must be cancelled prior to the renewal date in order to end membership charges. Juniper Dance & Fitness School does not refund any paid and unused membership for rental videos or subscriptions. You are welcome to cancel your subscription at any time and you will retain access to all remaining time you have prepaid for. If you cancel you will not be billed at your next billing cycle. All billing is in Great British Pounds (GBP/£). Juniper Dance & Fitness School is not responsible for any conversion or transaction fees charged by Paypal or the customer’s banking institution.

10) Disclaimer of warranties

You agree that your use of this website will be at your sole risk. To the fullest extent permitted by law, Juniper Dance & Fitness School, its officers, directors, employees and agents disclaim all warranties, express or implied, in connection with the website and your use thereof. Juniper Dance & Fitness School makes no warranties or representations about the accuracy or completeness of this website’s content and assumes no liability for any (i) errors, mistakes or inaccuracies of content, (ii) personal injury or property damage of any nature whatsoever, resulting from your access to and use of our website, (iii) any unauthorised access to our secure servers and/or any and all personal information and/or financial information stored therein, (iv) any bugs, viruses, trojan horses, or the like which may be transmitted through our website by any third party, and/or (v) errors or omissions in any content for or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted or otherwise made available by the website.

11) Limitation on Liability

In no event shall Juniper Dance & Fitness School, its officers, directors, employees and agents be liable to you for any direct, indirect, incidental, special, punitive or consequential damages whatsoever resulting from (i) errors, mistakes or inaccuracies of content, (ii) personal injury or property damage of any nature whatsoever, resulting from your access to and use of our website, (iii) any unauthorised access to our secure servers and/or any and all personal information and/or financial information stored therein, (iv) any interruption or cessation of transmission to or from our website, (v) any bugs, viruses, trojan horses, or the like which may be transmitted through our website by any third party, and/or (vi) errors or omissions in any content for or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted or otherwise made available by the website. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.

12) Indemnity

You agree to defend, indemnify and hold harmless Juniper Dance & Fitness School, its subsidiaries, affiliates, subcontractors, officers, directors, employees, consultants, representatives and agents from and against all claims, damages, obligations, losses, liabilities, costs or debt and expenses arising from (i) you use of and access to this website, (ii) your violation of any term of this agreement, (iii) you violation of any third party right, (iv) any claim that one of your submission of content caused damage to a third party. This defence and indemnification obligation will survive this agreement and your use of the website.

13) Ability to accept terms of service

You agree that you are at least eighteen years of age and are fully able and competent to enter into this agreement, conditions, obligations, affirmations, representations, and warranties set forth in this agreement and to abide and comply with this agreement.
